More than 1100 inmates did not return to prison after the end of the year getaway

At least 1,131 inmates did not return to prison units after their temporary release at the end of the year in the state of São Paulo. According to the Penitentiary Administration Secretariat, the Judiciary authorized the temporary departure of 30,382 re-educated students from the semi-open regime between December 23, 2025 and January 5, 2026.

Granting the benefit is the responsibility of the Judiciary and the temporary departure is provided for in the Criminal Execution Law, with dates regulated in the state by Ordinance DEECRIM 02/2019 and complementary rules.

According to the Secretariat, inmates who do not return to the prison unit within the established period are considered fugitives. In these cases, the prisoner automatically loses the benefit of the semi-open regime and, when recaptured, returns to the closed regime.
