Italian court gives new decision authorizing extradition of Zambelli in case of illegal possession of weapons, says ambassador

The Italian Court accepted this Thursday (16) Brazil’s request for the extradition of former deputy Carla Zambelli. This time, in the case involving illegal possession of a weapon (read more below). The information was confirmed by the Brazilian ambassador in Rome, Renato Mosca de Souza. The decision can still be appealed. This case refers to an episode that occurred on the eve of the second round of the 2022 elections, when she chased, armed, a man through the streets of the Jardins neighborhood, in São Paulo, after a political discussion. The images of the deputy running with a pistol in hand led to the opening of investigations at the Federal Supreme Court (STF), which condemned her for illegal possession of a firearm and illegal harassment using a weapon. Italian court decides to extradite Carla Zambelli In a different case, involving the invasion of systems of the National Justice Council (CNJ), in which Zambelli was also convicted, the Italian court had already decided to authorize the extradition (understand more below). However, the former deputy’s defense filed an appeal on April 10 to try to reverse this decision. This feature has not yet been analyzed. Zambelli has Italian citizenship and left Brazil in May last year, across the border with Argentina. Before arriving in the European country, she also passed through the United States. As she fled the country after a Supreme Court conviction, Zambelli is considered a fugitive from Brazilian justice. Therefore, the STF formalized an extradition request, signed by the case’s rapporteur, Minister Alexandre de Moraes. Zambelli remains imprisoned in Rome, because authorities in the European country understand that there is a risk of escape. Understand the case 👉 Brazil and Italy have a reciprocal extradition treaty, in force since 1993 – and which has been activated dozens of times since then. The first article of the treaty even determines that Brazil and Italy are obliged to hand over to each other people who are wanted by the other country – whether to be brought to trial or to serve a sentence restricting their freedom. 👉 In December, the Brazilian Federal Supreme Court (STF) ordered the revocation of Zambelli’s mandate, revoking a contrary decision by the Chamber of Deputies. She delivered a letter of resignation to the House three days later. Zambelli was sentenced by the STF to 10 years in prison for hacking into CNJ systems, and fled to Italy after the decision.
