This Tuesday (23), the government published a Provisional Measure that authorizes the withdrawal of the FGTS balance that was retained for workers who opted for the birthday withdrawal and were fired without just cause.
The initiative should reach around 14.1 million people and generate an estimated impact of R$7.8 billion. The release of resources seeks to correct a distortion in the anniversary withdrawal legislation, which until then prevented access to the full value of the fund in the event of dismissal, only allowing the receipt of a 40% termination fine.
Payments will be made in two stages. The first installment, limited to R$1,800, is expected to be paid by December 30th. The rest of the amount will be released later, according to the schedule defined by the government.
The measure applies to workers laid off between January 2020 and December 23, 2025, the period covered by the new rule established in the Provisional Measure.
