The United States Court of Appeals to the Federal Circuit in Washington ruled on Friday (29) that the tariff imposed by the Donald Trump government to imports from other countries based on the International Emergency Economic Powers Law (IEEPA) is illegal.
According to information from Axios and CNBC, the Court confirmed a decision from the end of May of the International Court of Commerce, which was later suspended temporarily by the United States Court of Appeals to the Federal Circuit to hear arguments about the case.
In August, the United States readjusted rates that had imposed in April on imports from other countries – the surcharge on Brazil was increased from 10% to 50%, which came into force on the 6th – based on IEEPA.
However, rates based on this law are not canceled because the Court of Appeals suspended the decision until October 14, in order to give the Trump government time to request the Supreme Court to analyze the case.
The court said it did not come to a conclusion about whether an American president could authorize rates alleging emergency powers only that Trump’s justification for tariffs (commercial deficit with other countries) does not constitute an emergency.
“The only question we resolved in the appeal is whether the transport rates and reciprocal tariffs imposed are authorized by IEEPA. We conclude not,” the court said in the decision.
However, the decision does not affect Trump tariffs on car imports, automotive parts, steel and aluminum, which were based on the commercial expansion law and not on IEEPA.
A few minutes after the decision, the US president commented on the matter on the Truth Social network.
“Today, a highly party court of appeals said incorrectly that our tariffs should be removed, but they know that the United States of America will win in the end. If these tariffs were someday removed, it would be a total disaster for the country. It would make us financially weak, and we have to be strong,” Trump wrote.
“The US will no longer tolerate huge commercial deficits and unfair rates and non -tariff barriers imposed by other countries, friends or enemies, who harm our manufacturers, farmers and all the rest,” the US president said, “the help of the US Supreme Court” to reverse the decision.
