Former deputy Eduardo Bolsonaro said on his social network According to Eduardo, Secretary of State Marco Rubio’s endorsement of the report by that country’s House Judiciary Committee shows that the US is “attentive” to “persecution and censorship” in Brazil.

“If this situation does not become more democratic, there is a risk that Brazil will not have its election recognized by the beacon country of freedom”, declared Eduardo in his account on the X network.

The US State Department declared this Wednesday that it follows with “serious concerns” judicial decisions and actions by the government of Luiz Inácio Lula da Silva (PT) which, according to the agency, “restrict” freedom of expression. According to the ministry’s note, the White House monitors alleged actions by the Brazilian government to “suppress” critics and court orders that go against the right of users to express themselves on social networks – some owned by American companies.

For Eduardo, the report “exposes the tactics” of Federal Supreme Court (STF) minister Alexandre de Moraes, with the minister’s explicit support for the Lula government. “This in the USA is something very serious, it certainly won’t stay like this. Congratulations, Moraes, you once again managed to put the Brazilian judiciary in the mud”, he said.

Magnitsky again

Later, in an interview with SBT NewsEduardo declared that the magistrate’s practices could lead to the application of the Magnitsky Law again to Moraes and another STF minister. Eduardo does not mention which minister he would be, but the report would involve the name of Dean Gilmar Mendes, for his joint work with Moraes in censoring the big techs.

“The report mentions that in Brazil, by banning or suspending accounts and information on social networks of right-wing people, it unbalances an electoral process. The report talks about censorship. And censorship is a form of unbalance, because society will not have access to information”, said the former deputy to SBT.

Moraes was sanctioned by the US based on Lei Magnitsky in July 2025, following US Treasury Department regulations. The sanctions were later lifted in December of the same year. The Magnitsky Act is used to punish foreign officials accused of human rights violations or serious corruption and freezes the assets of the person sanctioned and also any economic ties with the USA, preventing, for example, the use of credit cards.

Gazeta do Povo asked the STF if the ministers’ office would comment on the statements, but received no response. The space remains open.
