Parliamentarians from PSOL and Rede called the Attorney General’s Office this Monday (23) to ask the Attorney General, Paulo Gonet, together with the Federal Supreme Court, to annul two recent court decisions from lower courts that did not recognize the crime of rape against minors under 14 years of age.
One of the decisions refers to the acquittal of a 35-year-old man accused of rape of a 12-year-old girl by the Court of Justice of the State of Minas Gerais. The document asks Gonet to present an Allegation of Non-compliance with a Fundamental Precept so that it reaffirms the consolidated jurisprudence of the Superior Court of Justice.
The STJ text points out that the victim’s eventual consent, previous sexual experience or the existence of a romantic relationship are irrelevant to the configuration of the crime.
The request is signed by federal deputies Fernanda Melchionna, Sâmia Bomfim and Heloísa Helena and by district deputy Fábio Felix. The objective of the ADPF would be to “prevent readings that undermine the scope of the constitutional protection of childhood and adolescence”.
