The demonstrations of a closed-door STF meeting, which sealed the departure of Minister Dias Toffoli from reporting on the Master case, were leaked in the press. The website Power 360 reproduced entire sentences that magistrates would have said. Due to the fidelity with which the phrases were quoted, the ministers declared, behind the scenes, that they suspected they had been recorded by minister Dias Toffoli, as reported by the Folha de S.Paulo.
According to the Power 360the tone of the meeting would have been “political” and with an objective of “self-preservation” for the magistrates. The score for maintaining the rapporteurship with Toffoli would be 8 in favor and 2 against, but he would have agreed to leave the rapporteurship in exchange for a note of support with the unanimity of the ministers – an idea that, according to the report, would have come from Flávio Dino. Dino and Toffoli have a decades-long relationship.
The version of a corporatist agreement was reinforced by Toffoli’s statements upon leaving the court, saying that it was “all unanimous” and that the meeting would have taken place in an “excellent” atmosphere. Many complaints of discomfort about the actions of the Federal Police would have marked the conversations.

Toffoli told the columnist Sheet Mônica Bergamo who did not record and did not report “anything to anyone”. Then, he suspected that an IT employee might have made the recording. THE People’s Gazette contacted the STF communications department and is awaiting a response.
Deadlock avoided with Dino agreement
O Power 360 reported that, in a first meeting with fewer ministers, in the early afternoon of Thursday (12), Moraes and Gilmar Mendes had declared that they would vote in favor of keeping Toffoli in the Master case rapporteur, to which Carmen Lúcia and Edson Fachin had expressed their opposition. With the impasse, the matter would only be resolved in a plenary vote this Friday.
The excerpts that raised the suspicion of a leak would be entire sentences, like that of Gilmar Mendes, who reportedly said: “I think what’s behind this is that Minister Toffoli made some decisions throughout his time in this Master case here at the STF that contradicted the Federal Police. And the Federal Police wanted to fight back.”
Taxi drivers against the Supreme Court
Carmen Lúcia would have said that every taxi driver she talks to “speaks badly of the Supreme Court. The population is against the Supreme Court”. And that, despite having confidence in Minister Toffoli, it would be necessary to “think about institutionality”.
Still according to a report from the Power 360Luiz Fux would have said “Minister Toffoli has public faith in me. My vote is in favor of him. It’s over. I don’t know what you are discussing”. DIno would have called the PF’s 200 pages of evidence “legal rubbish”.
Several other ministers would have spoken out in favor of Toffoli, which was the keynote of this meeting. As all the speeches reproduced were favorable to the minister, the hypothesis arose that he had recorded the meeting with his colleagues, a flagrant “breach of trust”, according to his colleagues, which he vigorously denied, saying he was “discreet”.
Even so, the ministers ended up concluding at this meeting that, to guarantee what they called “institutionality”, the best thing for the Court would be for the solution proposed by Dino de Toffoli to be removed from the rapporteurship of the Master case and for it to be drawn, which ended up defining André Mendonça as the new rapporteur.
