Moraes exchanges conviction of military personnel from Nucleus 3 of the coup plot for providing services

Minister Alexandre de Moraes, of the Federal Supreme Court, approved the agreements signed between the Attorney General’s Office and the military men Márcio Nunes de Resende Jr. and Ronald Ferreira de Araújo Júnior, in the Criminal Action on the attempted coup d’état.

They were part of Nucleus 3, made up of nine high-ranking military personnel and a Federal Police agent. In November last year, the First Panel of the STF convicted the two soldiers of criminal association and incitement of the Armed Forces against the Constitutional Powers, crimes considered to be minor.

For this reason, they were able to replace the sentences with Non-Prosecution Agreements, that is, in exchange for no legal proceedings, the defendants will have to comply with conditions, such as the provision of services and compensation for damages.

The agreement was signed with the Public Prosecutor’s Office, considering that there was a confession of the crimes committed and the other requirements set out in the Code of Criminal Procedure were met.

In the decision, Minister Alexandre de Moraes noted that, in this case, the ANPP is a sufficient, necessary and proportionate measure to disapprove and prevent the crime, due to the conditions provided. According to the agreement, the military committed to providing services to the community or public entities for 340 hours, observing a minimum of 30 hours per month, in a location to be indicated by the executing court. They will also pay the amount of R$20,000 for repairs, divided into equal and successive installments.
