US Chamber accuses Moraes of censorship and legal war

The Judiciary Committee of the United States House of Representatives released this Wednesday (1st) a report in which it expressed concern about Brazilian Justice decisions regarding social networks and alleged that the Minister of the Federal Supreme Court (STF) Alexandre de Moraes practices censorship and legal warfare that could interfere in the Brazilian presidential election, which will be held in October.

“Content removal orders [de redes sociais] issued by Brazil globally, its coordination with US and foreign censors, and the removal of legal protections for American social media platforms pose a threat to Americans’ freedom of expression,” the report alleged.

“These actions demonstrate that Brazil does not just seek to silence political dissent within its borders, but rather to suppress freedom of expression throughout the world, including in the United States,” accused the committee.

Regarding the October election, the collegiate stated that “many of Minister Moraes’ censorship orders target his political opponents and those of President Luiz Inácio Lula da Silva [PT]both in Brazil and abroad, on the eve of the Brazilian presidential elections”.

“For example, between September 2025 and February 2026, Minister Moraes issued a series of orders against Eduardo Bolsonaro [PL-SP] — son of former Brazilian president Jair Bolsonaro [PL] and brother of Flávio Bolsonaro [PL-RJ]one of the main candidates for the Brazilian presidency — who currently resides in the United States and is an important supporter of the imposition of American sanctions against Minister Moraes”, highlighted the report.

“These censorship orders from Minister Moraes and the requests for information from the Brazilian Federal Police related to the underlying investigation prohibit platforms from ‘disclosing the decision to suspend confidentiality — as well as the preservation of the data itself — to the profile owners, given the confidential nature of the investigation and the risk of obstruction’, making the orders secret both to the public and to the target of censorship,” the committee wrote.

The collegiate added that, in November 2025, “at the same time as issuing these censure orders, Minister Moraes was one of the ministers of the Federal Supreme Court who voted in favor of the trial of Eduardo Bolsonaro for his political activities in the USA”.

Arguing that “Minister Moraes’ campaign of censorship and legal warfare strikes at the heart of Brazilian democracy and threatens freedom of expression in the United States”, the Judiciary Committee recalled that Flávio Bolsonaro and Lula appear “virtually tied” in the polls for the presidential election.

“Minister Moraes’ censorship orders and legal war against the Bolsonaro family and their supporters could significantly harm their ability to speak out online on matters of public importance in the months leading up to the Brazilian presidential election,” said the committee, which stated that it “will continue to oversee threats of foreign censorship to inform legislation that protects the fundamental rights of American citizens.”

The committee is chaired by Republican Representative Jim Jordan and the majority of its members are also from the party of American President Donald Trump.

A People’s Gazette requested a position on the report from Moraes, through the STF press office, but has not yet received a response. This text will be updated if there is a response.
