The Senate Constitution and Justice Committee postponed until April the analysis of the Proposed Amendment to the Constitution that aims to end compulsory retirement as a punishment for public servants. From now on, senators must hold public hearings to debate the topic.
The rapporteur, senator Eliziane Gama, will receive new amendments with the aim of updating her report. According to the text of the Minister of the Federal Supreme Court, Flávio Dino, the maximum punishment for magistrates and members of the Public Ministry – which is currently compulsory retirement – and for military personnel, the so-called fictitious death, is now dismissal or other penalties, according to the legislation of each career. If approved by the CCJ, the PEC will go to the Senate Plenary for a vote.
The senators also approved the holding of a public hearing to debate the topic, which was scheduled for April 1st. As a result, the text should only return to the voting agenda on April 8th. The PEC is authored by the minister of the Federal Supreme Court (STF), Flávio Dino, who, in 2024, was a senator.
