By 6 votes to 3, the United States Supreme Court struck down this Friday (20) the main pillar of President Donald Trump’s trade strategy: the policy of reciprocal tariffs on imported products. According to the decision, Trump exceeded his authority by imposing the tariff and must submit any measure related to taxation to Congress. These tariffs were announced in April 2025 and vary between 10% and 50% on products from practically all American trading partners, including Brazil. The amount raised is estimated to be more than US$175 billion, but it is not clear whether the American government will need to return the amount. The decision has strong political weight. It was the first time since Trump’s return to the White House that the Supreme Court imposed a direct limit on the president’s power. He responded immediately and reported that he will use a new legal instrument to apply another global tariff of 10%.
