In reality, although I’m sure that was not the intention, the Supreme Court’s decision today has made a president’s power to regulate commerce and impose TARIFS even stronger and starkly clear, rather than weaker. There will no longer be any doubt, and the revenue that is coming in, as well as the protection of our companies and our country, will, in fact, increase because of this decision. Based on a long legal tradition and hundreds of favorable decisions to the contrary, the Supreme Court did not strike down TARIFFS; it merely overturned a specific use of IEEPA-based tariffs. The ability to block, embargo, restrict, license, or impose any other condition on a foreign country’s ability to trade with the United States under IEEPA was fully confirmed by this decision. To protect our country, a president can actually charge more TARIFF than I have been charging in the past based on the various other tariff authorities, which have also been confirmed and fully authorized.
