The Antifaction PL, approved by the Chamber of Deputies on Tuesday night, now awaits sanction or veto by President Lula.
The text, which provides for stricter penalties for organized crime, was reported in the House by the federal deputy and former secretary of Public Security of São Paulo, Guilherme Derrite, (PP-SP). In the final version, Derrite reinserted into the text amended by the Senate the term “ultraviolent criminal organization” and the creation of the criminal type of “structured social domain”.
In an interview with Afternoon Band News this Wednesday (25), with Vitor Brown, the rapporteur detailed the new crimes defined in the project.
“We are talking about penalties for 10 new criminal types: domination of territory, ATM explosion, domination of cities, use of weapons exclusive to the Armed Forces. All of this becomes new criminal types of the legal system, with new qualifiers with sentences of at least 20, reaching up to 40 and, with the qualifiers, 65 years in prison.”
The approval in the Chamber was symbolic and only happened after an agreement with the government that was announced by President Hugo Motta. The seam took a large part of the base by surprise due to the resistance to changes in the proposal.
The text also expands asset blocking mechanisms and provides for the return of money from organized crime to federal and state public security funds. To do this, it will not be necessary to close the process.

The approved project also determines deadlines for the actions of the police, public prosecutor’s office and judges in investigations involving criminal factions and provides for a cut in prison aid for family members of faction leaders, as well as a restriction on the voting rights of prisoners involved in these organizations.
Initially forwarded by Planalto, the project against organized crime was modified by opposition parliamentarians, against the wishes of the government base, in November. In the Senate, it was changed again with the inclusion of a mechanism that taxed bets to finance the fight against organized crime. This change was overturned by deputies
The Minister of Justice, Wellington César Lima e Silva, complained about the final text.
“The Senate’s text was indeed improved by the Ministry of Justice. We are sure that we produced a better text. Either we would fold our arms and let that version be processed or we would seek to improve this version”, he said at a press conference.
The government’s expectation is that President Lula will sanction the proposal with partial vetoes.
The trigger for PL Antifaction was the mega-operation that left 121 people dead in Rio de Janeiro, the most lethal in Brazil’s recent history.
Since then, security has become a central theme among pre-candidates for the Palácio do Planalto this year.
In a survey released at the beginning of the month, the Instituto Paraná Pesquisas revealed that 22.2% of respondents point to public security as the country’s biggest problem, followed by public health, cited by 20.1%.
The survey, carried out between January 25th and 28th, interviewed 2,080 voters in 160 municipalities in the 26 States and the Federal District and has a margin of error of 2.2 percentage points.
