Minister Flávio Dino, of the Federal Supreme Court, prohibited, this Thursday (19), the application of new laws on the payment to public servants of remuneration and compensation installments that exceed the constitutional ceiling. Payments are known as “hangings”.
According to Dino, the measure seeks to “clarify and complement” the preliminary decision of the 5th, when the minister ordered the suspension of payments made without express legal provision. The decision also extends the blocking of payments to the recognition of supposed retroactive rights that were not paid until the date of the original injunction.
The measure applies to federal, state and municipal institutions. The case now goes to a vote in the STF Plenary, which should consider the issue on the 25th.
