Moraes grants house arrest to General Heleno

by Marcelo Moreira

This Monday (22), Minister Alexandre de Moraes granted house arrest to General Heleno, after being sentenced by the Federal Supreme Court (STF) to 21 years of imprisonment for being involved in the invasion of the magistrates’ headquarters, on January 9, 2023.

The decision is based on article 21 of the Court’s Internal Regulations and considers humanitarian reasons to authorize Heleno’s transfer from the place of detention, at the Planalto Military Command, to carry out the measure at his residence.

Among the restrictions noted are: use of electronic ankle bracelets, delivery of all passports, immediate suspension of any documents that may contain firearms, ban on visits (except those of their lawyers, medical team and people authorized by the STF) and ban on mobile devices.

According to the court order, the convicted person must request prior authorization from the Supreme Court to carry out any travel for medical purposes. However, in emergency or urgent situations, departure is authorized, as long as the defense presents the justification and the respective medical report within 48 hours of assistance.

The release permit with restrictions has already been issued urgently, and both the military authorities and the Attorney General’s Office (PGR) were duly notified about the decision.

Alzheimer’s diagnosis

Heleno informed the Army that he was diagnosed with Alzheimer’s in 2018.

Before being sent to the prison system, he underwent a forensic examination, a standard procedure adopted to verify the detainee’s health conditions at the time of arrest.

According to the general himself, the disease was identified after he investigated recurring episodes of memory failures. Even with the diagnosis, the general assumed the position of minister of the Institutional Security Cabinet (GSI) during the government of former president Jair Bolsonaro, between 2019 and 2022.
