Flávio Dino blocks project that would resume “secret budget” in Congress

The minister of the Federal Supreme Court (STF), Flávio Dino, blocked an excerpt from a bill that releases amendments to the so-called “secret budget” that were not paid by the government from 2019 to 2023. The decision has a preventive nature and will be subject to a referendum in the Court’s plenary session.

The target of the action is article 10 of Complementary Bill 128 of 2025, which provides for the “revalidation” of outstanding payments since 2019, including those that have already been cancelled, allowing them to be paid until the end of 2026.

Dino understood that there are signs of violation of due budgetary process, fiscal responsibility and the Constitution itself. For the minister, the proposal seeks to “resurrect a modality of amendment whose very existence was considered unconstitutional”.

The text was approved by the Senate last Wednesday (17), but has not yet been sanctioned by President Lula. The deadline ends on January 12, 2026.
