TRF-1 revokes arrest of Daniel Vorcaro and the four executives of Banco Master

The Federal Regional Court of the 1st Region decided, this Friday (28), to revoke the arrest of the owner of Banco Master, Daniel Vorcaro, and four other executives of the financial institution. All were detained as part of Operation Compliance Zero, launched last week.

The decision replaces preventive detention with a set of precautionary measures provided for in the Code of Criminal Procedure, including the use of an electronic ankle bracelet. The restrictions must be fulfilled cumulatively while investigations into the alleged scheme investigated by the Federal Police progress.

In addition to Vorcaro, the benefit also extended to the investigated Augusto Ferreira Lima, Luiz Antonio Bull, Alberto Feliz de Oliveira and Ângelo Antonio Ribeiro da Silva, as determined based on article 580 of the CPP. The businessman had been detained at the Provisional Detention Center 2 in Guarulhos since Monday (4), after having spent a few days at the PF Superintendence in São Paulo.

The defense of Daniel Vorcaro, owner of Banco Master, worked on several fronts to try to guarantee his freedom. In addition to the appeal that resulted in the TRF-1 decision, the lawyers had also appealed to the Superior Court of Justice (STJ) and the Federal Supreme Court (STF).

In the request presented to the STJ, the defense maintained that the preventive detention was undue, arguing that there were no concrete elements that demonstrated a real risk of interference in the investigations. According to the lawyers, the businessman would not be able to repeat the conduct attributed by the Federal Police, since the Central Bank has already decreed the extrajudicial liquidation of Banco Master.

Speaking to the court, the defense stated that the institution is no longer under any interference by Vorcaro. “The fragile economic situation of Banco Master is already protected by the extrajudicial liquidation decreed by Bacen. There is no longer any interference by the patient in that institution”, they argued.

Earlier this Friday, the lawyers had also sued the Federal Supreme Court. In the request to the STF, they claimed that the Federal Court that ordered Vorcaro’s arrest would not be the competent forum to conduct the case. The case is being reported by Minister Dias Toffoli, and there is still no forecast for a trial.
