The session will take place in a virtual plenary and in this model, there is no debate between ministers. The magistrates will have from 8am to 8pm to vote on whether or not to endorse Alexandre de Moraes’ decision.
Flávio Dino and Moraes make up the First Panel alongside ministers Cármen Lúcia and Cristiano Zanin. Minister Luiz Fux requested at the end of October to leave the collegiate, migrating to the Second Class.
Jair Bolsonaro was arrested this Saturday morning (22) after a request from the Federal Police (PF) to the Federal Supreme Court (STF). Minister Alexandre de Moraes decreed preventive detention, claiming the maintenance of law and order. The former president was already under house arrest.
A custody hearing has already been scheduled for this Sunday (23) to verify whether the arrest was carried out legally and whether the detainee’s rights were respected. The process is mandatory even in prisons ordered by the STF.
