OX, through your global government affair account on the platform, questioned on Monday (1st) the impartiality of bodies certified by the European Union (EU) for extrajudicial resolution of content moderation disputes.
The EU’s Digital Services Law (DSA) provides for the existence of such bodies as a “additional opportunity” for users to resolve disputes on content moderation with online platforms.
Organizations wishing to provide this service must request registration from a national certifying authority, the coordinator of digital services in the country where they are established, and meet criteria such as impartiality, independence and specialization.
However, the X claimed that such criteria would not be followed by extrajudicial resolution bodies that arbitrated recent disputes involving the platform.
“This is equivalent to transforming what should be an ordained and subjective process into something similar to the Old West justice. OX is already realizing cracks in the system, with immediate flaws that are emerging and compromising impartiality and independence [dessa arbitragem]”, He accused.
OX stated that three of these agencies have recently contacted the platform to revise content moderation decisions and several problems were detected.
“Two imposed in hurry deadlines, denying our company time to respond. One was historically funded/maintained by a competitor. Another is funded/operated by the state. The third party’s expertise is vague at best. However, each of them has extraordinary authority to contest our business,” he criticized.
“Opacity around the extrajudicial resolution bodies of disputes is not only worrying, it is unfair. Information available on resolution bodies offers insufficient details on financing, certification or impartiality. This information must be public and comprehensive,” said X.
The EU has not yet commented on the considerations made by the X Global Government Affairs account.
