Minister Alexandre de Moraes of the Federal Supreme Court (STF) authorized on Monday (29) the progression of former Deputy Daniel Silveira for the open regime. The decision imposes measures such as use of electronic anklet, home collection and the maintenance of the prohibition of access to social networks.
Silveira should stay at home from 19h to 6am on weekdays. On weekends and holidays, the payment will be full. Any displacement out of the municipality where it meets a penalty will depend on judicial authorization.
The determination also requires the former parliamentarian to present formal employment bond in legal activity. In addition, he will have to appear weekly to court to justify his occupations.
Remember the case
The Supreme sentenced Daniel Silveira in 2022 to 8 years and 9 months in prison for inciting undemocratic acts and attacking court ministers and institutions. The sentence also determined the loss of mandate, suspension of political rights and a fine of R $ 212 thousand.
In December 2024, Moraes authorized his progression to the open regime. Four days later, Silveira was arrested again for breaking rules, such as the prohibition of gun possession and the use of social networks.
In early 2025, the minister denied requests for pardon and parole made by the defense, but allowed the transfer to the semi -open regime.
In March, Moraes rejected a new request, this time for the temporary departure of Easter. Since then, Silveira has remained in the Rio de Janeiro Penitentiary System until Monday’s decision.
