Edson Fachin marks session to decide number of deputies for the 2026 elections

On his first day as president of the Supreme Federal Court (STF), Minister Edson Fachin marked an extraordinary virtual session for this Tuesday to judge the action on changes in the composition of the House of Representatives.

The ministers will analyze the decision of Minister Luiz Fux, who upheld the number of deputies per state for the 2026 elections. Fux complied with a request from Senate President David Alcolumbre. In the decision, the minister stated that the legislative process has not yet been closed, since “the full veto bet by the President of the Republic has not yet been deliberated by the Legislative Power.”

The action suspends the determination of the STF itself, made in 2023, which required Congress to resume the distribution of chairs in the House based on updated population data. That year, Congress approved a bill that increased the number of deputies from 513 to 531, but President Lula vetoed the measure. Now, the change identified by the census should only come into force from 2030.
