Government triggers World Trade Organization against Trump’s tariff

The Ministry of Foreign Affairs has called the World Trade Organization (WTO) from the 50% tariff determined by President Donald Trump, who came into force on Wednesday (6). The so -called “request for consultation” was formalized at the headquarters of the agency in Geneva, Switzerland.

In the document, the government mentions that, by imposing the overcuts, the US “violates caught central commitments made by that country on the WTO” and says that the bilateral consultation was requested to “seek a negotiated solution for the dispute.”

The government finished the note reiterating the willingness to negotiate and informing that the date and place where the process will be agreed between the two parts in the coming weeks.

Request for consultations to the United States on the WTO for tariffs imposed on Brazilian products

Brazil filed a request for consultations to the United States of America (US) under the World Trade Organization (WTO) controversy system.

The request questions tariff measures applied through the executive orders entitled “Import Regulation with a reciprocal fare to correct commercial practices that contribute to high and persistent annual commercial deficits in US goods”, of 2 April 2025, and “approach to threats to the United States by the Government of Brazil”, of July 30, 2025. In addition, the measures may result in application of application Tariffs up to 50% over wide range of Brazilian products.

The overcutments were adopted based on US legislation, such as the International Emergency Economic Economic Powers Law-IEEPA) and the 301 section of the 1974 North American Trade Law.

By imposing the aforementioned measures, the US violates the central commitments made by that country on the WTO, such as the most favored nation principle and tariff ceilings traded within that organization.

Bilateral consultations, designed for the parties to seek a negotiated solution for the dispute before the eventual establishment of a panel, are the first formal step within the dispute solution system in the WTO.

The Brazilian government reiterates its willingness to negotiate and expects consultations to contribute to a solution to the issue.

The date and site of the consultations must be agreed between the two parts in the coming weeks.
