Minister Dias Toffoli denied the request of the defense of former governor Sergio Cabral to extend to him the effects of the decision annulled the procedural acts against moneymaker Alberto Youssef in Operation Lava Jato.
Cabral’s request was based on Toffoli’s previous decision, which stated null the actions filed against Youssef for judging that there was a collusion between the then Judge Sérgio Moro and members of the Federal Public Prosecution Service, to the detriment of the defendant’s right to defend the defendant.
In the new request, the former governor’s defense claimed that he was directly impacted by the illegalities committed against Youssef, named as a central figure of Lava Jato investigations. Nevertheless, the Supreme Court Minister considered that the arguments presented do not fit the same elements that underlie his decision on Youssef.
