Bolsonaro’s defense resorts to the Supreme Court against house arrest

The defense of former President Jair Bolsonaro appealed in the Supreme Federal Court (STF) requesting the revocation of the house arrest, determined by Minister Alexandre de Moraes.

In the appeal, the lawyers deny that Bolsonaro failed to comply with the determinations of the Court. According to the defense, the video message aimed at Copacabana supporters was restricted to “generic expressions” and there was no reiteration of conduct that could be considered criminal offenses.

According to the lawyers, Bolsonaro could not be punished by demonstrations made by third party profiles on social networks, claiming that he has no control over the repercussion of supporters made by supporters.

“The former president was not prohibited from giving interviews or manifesting, and as already alerted, does not have control over third parties that may reflect the content arising without their direct or indirect participation,” says the defense text.

The appeal will initially be analyzed by Moraes. However, the lawyers asked the case to be taken to the first class of the Supreme Court, composed by ministers Flávio Dino, Luiz Fux, Cristiano Zanin, Cármen Lúcia and Moraes himself.

The defense maintains that the arrest cannot be applied automatically, even if it was already foreseen in case of breach of precautionary measures.

“It is indispensable the validation by the class, in strict service to the internal regulations of the STF,” added the lawyers.
