Wednesday (13) will be the deadline for Jair Bolsonaro’s lawyers to present the former president’s defense to the Supreme Court (STF). The allegations are the final step before the decision that may result in conviction or acquittal.
With the delivery of this phase, Minister Alexandre de Moraes must release the criminal action – related to core 1 of the complaint – for judgment in the Supreme Court. The responsibility to set the date will be of Minister Cristiano Zanin, president of the first class of the Court. The trial is expected to take place in September.
In addition to Moraes and Zanin, the collegiate is part of the ministers Flávio Dino, Cármen Lúcia and Luiz Fux. Defendants are accused of crimes such as attempted coup, armed criminal organization, attempted abolition of the Democratic Rule of Law, qualified damage using violence and threat, as well as deterioration of listed public heritage.
If convicted, penalties may exceed 30 years in prison. However, the execution of the sentence will not be immediate – the arrest may only occur after the judgment of any appeals presented by the defense.
Nor is it expected to arrest the defendants in ordinary prisons. By law, armed forces officers are entitled to special arrest, as well as Federal Police delegates. Among the accused of core 1 are five army military personnel, one from the Navy and two federal delegates.
The names involved are: former President Jair Bolsonaro (retired captain), generals Paulo Sérgio Nogueira, Augusto Heleno and Walter Braga Netto, Admiral Almir Garnier, Lieutenant Colonel Mauro Cid (who signed an arrested agreement), Delegate Alexandre Ramagem and Delegate Anderson Torres, former Minister of Justice and former Security Secretary and former Secretary of Security DF.
