Wisconsin’s Supreme Court overturned Law that prohibited abortion 176 years ago

The progressive majority of the Supreme Court of the State of Wisconsin suspended on Wednesday (2), by four votes to three, a law that unrestrictedly prohibited abortion in the state of the Midwest of the United States.

The decision was taken in plenary after a request for lawsuit by Wisconsin Attorney General Josh Kaul, who argued that the state already has legislations that restrict abortion until “fetal viability between 21 and 24 weeks”.

The decision did not surprise legal experts, as the court is dominated by magistrates with a left -wide political inclination, although the state was won – by a small margin – by Donald Trump and the Republicans in the last presidential election.

The law, created in 1849, lost its validity for almost fifty years after the federal jurisprudence of the ROE vs. case. Wade in 1973, which prevented states from banning abortion until fetal viability. In 2022, ROE vs. Wade was revoked by the Supreme Court of the United States and since then each state could legislate separately on the subject.
