US Justice again suspends Trump’s order that limits citizenship by birth

The law was consecrated shortly after the civil war in the 14th Constitution Amendment. In a case discussed in the Supreme Court in 1898, United States v. Wong Kim Kim Ark, the court ruled that the only children who did not automatically receive American citizenship at birth on American soil were: the children of diplomats who had loyalty to another government; Enemies present in the US during hostile occupation; those born in foreign ships; and those born of members of sovereign American native tribes. At the end of June, the Supreme Court decided that judges in the first instance have no authority to decide on national issues or grant valid injunctions throughout the country. Aclu (US Union for Civil Freedoms) and other entities filed a few hours after the Supreme Court issued its decision and announce that Trump’s executive order would take effect on July 27. Trying to take advantage of the Supreme Court’s decision, the entities’ lawyers argued that the decision allows judges to continue to block Trump’s policies at the national level in collective actions. Trump’s Order guides federal agencies to refuse to recognize the citizenship of US -born children who do not have at least one parent who is a US citizen or legal permanent resident, also known as the bearer of the “Green Card”. More than 150,000 newborns would have the citizenship denied annually if the measure came into force at the national level, according to states led by democrats and defenders of immigrant rights.
