Two American companies importing orange juice, Johanna Foods e Johanna Beveragethey appealed to the New York International Trade Court against the tariff announced by the Government of Donald Trump to Brazil, which is expected to take effect on August 1.
In the 150 pages presented to the Court, the importers argued that Trump exceeded their presidential limits with the measure, based on the terms of the International Emergency Economic Powers Law. The 50% tariff threat to Brazil represents, according to companies, an “unconstitutional” act of the Executive Power.
The executive director of the American group, Robert Facchina, pointed out in the document that the taxation for Brazil will bring losses to national trade and consumers directly, who may have to pay up to 25% more for the purchase of basic products.
“Brazil’s fare will result in a significant and perhaps prohibitive price increase, a basic food of Americans’ breakfast,” the companies said.
In the action, importers still question the justifications used by Trump to tax Brazil, including support for former President Jair Bolsonaro and censorship actions imposed by the Brazilian courts against American companies.
