TPI issues arrest warrant against Taliban leaders

The International Criminal Court (ICC) issued arrest warrants on Tuesday (8) against Taliban leader, Mulá Hebatullah Akhundzada, and the president of the Afghan Supreme Court, Abdul Hakim Haqqani, for crimes against humanity involving women, girls and others based on the genre.

“Although the Taliban has imposed certain rules and prohibitions for the population as a whole, they target girls and women based on gender, depriving them of fundamental rights and freedoms,” says the PRELIMINARY CHAMBER statement.

The TPI accuses terrorists who control Afghanistan to deprive “girls and women of their rights to education, privacy and family life, as well as freedom of movement, expression, thought, conscience, and religion” through decrees and edicts.

“In addition, other individuals have been targeted because certain expressions of sexuality or gender identity are considered incompatible with Taliban’s gender policy,” the statement emphasizes that these crimes were committed since they took power on 15 August 2021, until at least 20 January 2025.

“This includes those who described themselves as ‘allies of girls and women’, who were perceived as political opponents,” the document adds.

The PRELIMINAR TPI camera also pointed out that Taliban policies have committed “serious violations of the fundamental rights and freedoms of the civilian population,” including “murder, prison, torture, rape and forced disappearance.”

Violations

After the escape of President Ashraf Ghani from the capital, Cabul, the Taliban returned to power in August 2021 – amid the removal of international troops – and imposed a series of restrictions on public life based on the laws of Sharia (Islamic law), with the main focus on women and girls.

The so -called law for the propagation of virtue and prevention of addiction, which will come into force in Afghanistan in August 2024, contains a disposition that women’s voices can only be heard “in cases of necessity.”

• A woman’s voice for being considered Awrah (word regarding body parts that must be covered in public for reasons of modesty and privacy) and should not be heard in public.
• Women should not be heard by reading aloud or singing, even inside their homes.
• Women’s clothing cannot be thin, short or fair.
• Women should hide their bodies and faces of men with whom they are not married or have no blood related.
• Men are also forbidden to look at women’s bodies and faces, and the same applies to adults who look at the bodies of men.
• Drivers cannot put music in the vehicle, transport women alone, and mix men and women who are not relatives. The law also requires passengers and drivers to pray at the appropriate time.
• Songs are banned in public places, on televisions, radios, shows and restaurants.
• Men should use beard, which cannot be too short.
• Friendship with non -Muslims is prohibited.
• Five prayers per day are mandatory.
• Women are prohibited from practicing any sport.
• Fights, such as martial arts (MMA), are prohibited.
• Games, like chess, are prohibited.
