Minister Dias Toffoli of the Federal Supreme Court (STF) approved on Thursday (03) the plan of the National Institute of Social Security (INSS) to begin the reimbursement of irregular discounts in the benefits of retirees and pensioners. Payments should start July 24 and will be made directly on the payroll.
The return will be made every 15 days from the starting date. Each lot should rely on R $ 1.5 million beneficiaries. In the same decision, Toffoli ordered the suspension of lawsuits and judicial decisions dealing with the responsibility of the INSS and the federal government about illegal discounts. The minister did not accept the request of the Federal Attorney General (AGU) to determine the opening of extraordinary credit in the budget to enable compensation. In the decision, the minister said that it is not up to the Supreme to determine the measure, which is the responsibility of the Congress.
The document approved by the Supreme Court includes measures already performed and in progress by the government, with the objective of quickly solving the problem by administrative, as well as an operational plan with guidance to INSS beneficiaries affected by illegal discounts. The agreement also provides for contesting channels, including active search actions in rural areas or difficult to access and wide dissemination of these channels. The associative entities will have 15 business days to return to the INSS the discounted amounts or prove, by unambiguous documentation, the associative bond with the beneficiary.
