Mauro Cid calls for acquittal to the Supreme Court and states that he acted “in the fulfillment of higher orders”

The defense of Lieutenant Colonel Mauro César Barbosa Cid presented to the Supreme Federal Court (STF) the final allegations in the case in which he is defendant for participation in the attempted coup. In the document, the lawyers ask for the acquittal of CID and claim that he acted “in the fulfillment of higher orders.”

According to the defense, Cid “did not belong, integrated or organized any criminal association aimed at shaking democratic institutions”, and never practiced “acts aimed at the realization of an institutional rupture.”

Protocolled last Tuesday (23), the final allegations are the last stage of the instruction phase of the criminal action before the trial in the first class. The document presented summarizes the process and brings the defense position on the case.

Judicial forgiveness

If Lieutenant Colonel is convicted, the lawyers ask the Supreme Court to grant judicial forgiveness, justified by their collaborative posture with the investigations. “Among the accused, no one had the courage of Mauro Cid. This dissent had concrete consequences. [Ele] It was and is still taxed as a traitor, in a true campaign of moral and psychological retaliation, ”said the text of the whistleblower.

Despite the request, the Attorney General’s Office (PGR) spoke out against the granting of judicial forgiveness. The agency claimed that the defendant opted for a selective narrative and omitted serious facts, resisting full compliance with obligations agreed in the award -winning plea agreement.

In the opinion, the Attorney General, Paulo Gonet, argued that the reduction of the sentence should only be 1/3. In the agreement signed with the PF and approved by the Supreme Court, the judicial forgiveness or prison sentence of less than two years was foreseen.

Obedience to Bolsonaro

In the document presented, the defense states that Mauro Cid’s performance as an assistant to former President Jair Bolsonaro “limited to organizing the presidential agenda” and did not involve “any degree of decision or political or institutional planning”.

The lawyers maintain that Lieutenant Colonel acted based on the military hierarchy and that this does not constitute a crime. The defense argues that Cid acted “without science or adherence to the alleged coup plan”, and that his collaboration was made “in order to clarify the facts.”
