This Tuesday (22), the São Paulo Court of Justice upheld the ban on paid passenger transport by motorcycles in São Paulo. In rejecting a new injunction filed by the National Confederation of Services (CNS), the court decision maintains the validity of the decree issued by the City.
According to Judge Ricardo Dip, there are no rules signed by the Federal Supreme Court (STF) that allow the immediate suspension of Municipal Decree No. 62.144/2023, as requested by CNS. The decree, which has been in force since 2023, regulates individual passenger transport in the city of São Paulo and prohibits the motorcycle taxi service. For the magistrate, there is no urgent or new risk that justifies the adoption of a provisional decision.
The city claims that the decision to prohibit individual motorcycle passenger transport is based on “worrying data on road safety and public health”. Technical studies conducted by a municipal working group have pointed out that this type of transport represents “a high risk to the physical integrity of drivers and passengers”.
According to the data collected, São Paulo recorded a 35% increase in the motorcycle fleet over the past decade and a 20% growth in the number of deaths between 2023 and 2024. In the first half of 2025 alone, SAMU recorded 7,753 accident occurrences involving motorcycles.
In June, the governor of São Paulo Tarcísio de Freitas (Republicans) approved the law that gives the municipalities of the State the freedom to authorize or prohibit paid passenger transport by motorcycles. In the same month, the court recognized the municipal decree in force in the capital and determined that the companies 99 Tecnologia Ltda and Uber interrupt the irregular activity – under penalty of application of daily fine of R $ 30 thousand.
With the court decision, the transport of passengers by application motorcycles is prohibited in the city of São Paulo. The debate on the regulation of the motorcyclex service is being held at the City Council.
