Justice of Minas Gerais prohibits hours of simultaneous shifts

The Court of Justice of Minas Gerais ordered the House of Charity of Viçosa (MG), responsible for the São Sebastião Hospital, suspendes the days of simultaneous dual -paying shifts. According to the prosecutor’s complaint (MP), the same professional worked in two vacancies at the same time, receiving twice.

The decision is appealed and was taken by the 2nd Civil Court of Viçosa. After investigations, irregularities were found in the medical shifts at the institution and, in April, Carlos Raimundo Torres Junior, provider of the São Sebastião Hospital, was removed by determination of justice.

According to the MP, one of the doctors received about $ 10,000 per week, totaling approximately $ 40,000 per month with hospital shifts alone. The action also mentions scales of up to 96 consecutive hours.

The Regional Council of Medicine (CRM) claims that, in the Code of Medical Ethics, there are no rules that determine a specific number of continuous hours that a professional can comply on duty and that the theme is treated in technical opinions of the regional councils.

In CRM-MG Opinion No. 125/2022, for example, it is recommended that the shifts greater than 24 uninterrupted hours will be avoided but without express prohibition.
