Licensed federal deputy Carla Zambelli (PL-SP) may be fined for not returning the functional apartment of the Chamber of Deputies within the stipulated deadline. The 30-day period for the eviction ended last Friday (4), and so far the delivery of the property has not been registered. Zambelli is on the run in Italy after being convicted by the Supreme Federal Court (STF) to 10 years in prison for involvement in the invasion of the National Council of Justice (CNJ) system.
According to the rules of the House, only parliamentarians in effective office of the mandate are entitled to occupy the functional properties. The deputy formalized her license on June 5, with seven days for health reasons and 120 days for private interest, without remuneration. The request was made before the order of pre -trial detention issued by Minister Alexandre de Moraes, of the Supreme Court.
Failure to comply with the deadline may result in a daily fine of R $ 284 for irregular occupation. If the property is not returned within ten days after the end of the license, a second penalty may also be applied: the full collection of housing allowance, in the amount of R $ 4,253 per month, while the irregularity lasts.
The advice of the House reported that, in case of misuse of the property, the deputy may be required to indemnify the institution. Zambelli’s defense, however, said she has not yet been formally notified of the need for eviction.
In addition to the judicial conviction, Zambelli also faces a process of loss of mandate that is being processed by the Chamber’s Constitution and Justice Commission (CCJ). The rapporteur of the case, Deputy Diego Garcia (Republicans-PR), should meet with party leaders in the coming days to define the rite of the process. The defendant’s defense handed the CCJ demonstration and requested a storage with hacker Walter Delgatti Neto, involved in the case.
