Tarcísio sanctions law that gives autonomy to municipalities about motorcyclexis in SP

The governor of São Paulo, Tarcísio de Freitas, sanctioned a law passed by the State Legislative Assembly that transfers to the municipalities the decision on the regulation of the motorcycle taxation. The measure was published in the Official Gazette on Monday and is already in force. With this, the city halls from São Paulo have autonomy to decide whether or not to transport passengers by motorcycles in their territories.

According to the text, the motorcyclex service can only be released in cities that create a specific regulation. Among the requirements are the collection of municipal taxes, the hiring of insurance for passengers and the registration of motorcyclists as taxpayers of the INSS. In addition, professionals must present a negative certificate of criminal record and have a driver’s license in category A.

In practice, the new state legislation favors the management of the state capital, which wages a court dispute with application companies that offer the service. The City of São Paulo, commanded by Ricardo Nunes, states that the law seals the decision to maintain the prohibition of mototaxis in the city. In a statement, the municipal executive stated that this is a “dangerous” modal and reiterated his position contrary to the release.

Even so, the debate on the possible regulation of the service continues in the City Council, where there are already proposals under discussion. Public hearings are being held with the objective of deepening the issue, but any final decision will still depend on the mayor’s endorsement. With the new legislation, each of the municipalities of the state of São Paulo will have the power to decide the future of motorcycle taxi in its municipalities.
