The Federal Supreme Court (STF) resumes this Thursday (26) the judgment on the responsibility of the Big Techs for the publication of illegal content by users. The discussion revolves around the Internet Civil Framework and can change the way companies that run social networks operate in Brazil. The score is 8 votes to 2 for the amendment of the law in force and there is still to vote Minister Nunes Marques.
On Wednesday (25), Minister Edson Fachin was the second vote contrary to the measure, following André Mendonça to maintain the requirement of court decision. Already Carmen Lúcia gave the eighth vote in favor of holding digital platforms. Most ministers understand that users are enough for companies for companies to remove criminal contents without the need for a court decision.
Even with the majority, the details of the decision have not yet been approved. The list of crimes is not yet closed and will be debated at the end of the trial, but should include, for example, racist posts or inciting suicide and self -mutilation.
